How EB-5 works, without the sales pitch.
EB-5 lets qualified foreign investors pursue U.S. permanent residency by investing in a business that creates American jobs. Here is what that actually requires, and where the rural exception changes the math.
The basics
Three requirements, no shortcuts.
Every EB-5 petition turns on the same three things: capital genuinely at risk, in a qualifying new commercial enterprise, that creates or preserves the required number of full-time jobs for U.S. workers.
"At risk" is the part people underestimate. The investment cannot be guaranteed, cannot carry a redemption right, and must remain deployed in the project through the required sustainment period. A project that promises safety is either misdescribing itself or disqualifying its own investors.
Jobs are counted against a methodology filed in advance and reviewed by USCIS. For regional center projects, indirect and induced jobs can count — which is why the economic model matters as much as the construction budget.
The rural difference
Why rural projects sit in a different category.
The 2022 reforms deliberately tilted the program toward rural America. Three advantages compound.

This sequence is genuinely sequential — each step depends on the one before it.

Site and operator qualification
We confirm the service gap, the physical asset, the licensure path, and the operator's track record before spending a dollar on structuring.

Feasibility and economic modeling
Independent economists build the job creation methodology and impact analysis. If the numbers don't support the raise, the project stops here.

Structuring and regional center sponsorship
The capital stack, entity structure, and loan terms are set, and the project is filed for sponsorship with a designated regional center.

Offering documents and compliance framework
Securities counsel prepares the offering materials. Escrow, fund administration, and reporting obligations are established before any subscription is accepted.

Capital deployment and construction
Funds release against defined conditions and construction draws. Investors receive periodic project reporting throughout.

Job creation, sustainment, and repayment
Employment is documented against the filed methodology through the sustainment period, and the loan is repaid on its stated terms.
Common questions
Questions we get asked early.
Is an EB-5 investment guaranteed?
No, and it cannot be. The program requires capital to be genuinely at risk. Any project or agent presenting an EB-5 investment as guaranteed, principal-protected, or redeemable on demand is describing something that would jeopardize the investor's own petition. Loss of some or all invested capital is possible.
How long does the process take?
Timelines depend on petition processing, visa availability for the investor's country of chargeability, and the project's own construction and job creation schedule. Rural projects receive priority processing by statute, but no one can promise a date. Your immigration counsel is the right source for a realistic estimate on your specific facts.
What does UHP do, and what does it not do?
We structure and capitalize projects and manage the sponsor-side compliance obligations. We do not provide legal, tax, or immigration advice, and we do not represent investors. Investors should retain their own independent immigration and securities counsel, and we will provide referrals if that is helpful.
Who actually runs the healthcare facility?
A licensed healthcare operator, separate from UHP. Clinical care, staffing, licensure, and patient services are the operator's responsibility. Our role is the capital structure and the reporting obligations that attach to it.
How are jobs counted?
Against an economic methodology filed in advance and reviewed as part of the project application. For regional center projects this can include indirect and induced employment. We use the independent economist's figures, including when they come in lower than the project team expected.
Can I see the offering materials from this website?
